In the event you have enrolled in multiple Hotel Direct Staffing Alert programs, the most recent (HDS) Mobile Alert program terms and conditions shall apply and will supersede any prior versions thereof.

Definitions 

"Applications" and/or "Content" refer to any file, device or software that can be downloaded by you to either a computer or a wireless device such as a handset or a personal digital assistant. 

"HDS Alerts" is a recurring service where text messages (including, but not limited to, SMS (Short Message Service) and MMS (Multimedia Message Service) messages) are sent by HDS via an autodialer to your mobile device. 

These text messages may contain, among other things, mobile alerts relating to HDS marketing and Job fair events.

Acceptance by You 

By Texting (1888) 723-2637 you have expressly agreed to be bound by the terms and conditions herein ("Agreement") and you are consenting to receive HDS text message disclosures ("Disclosures") electronically. If you do not consent to the terms of this Agreement and do not agree to receive electronic Disclosures, you must immediately cease using the Services that you have received and contact us as provided below. Your consent to this Agreement includes authorization for HDS to deliver Job advertising messages using an autodialer. 

 

TO THE EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICE, APPLICATIONS OR CONTENT THAT YOU RECEIVE FROM US, AND DISCLAIM ANY WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED. 

TWE WILL NOT BE LIABLE FOR ANY DELAYS IN THE RECEIPT OF ANY TEXT MESSAGES AS DELIVERY IS SUBJECT TO THE EFFECTIVE TRANSMISSION FROM YOUR NETWORK OPERATOR.

Limitation of Liability 
We are not responsible and will not be liable for any delays in the receipt of any text messages or other damages of any nature, including any incidental, special or consequential damages (such as lost profits or lost business opportunities), punitive damages or attorney's fees.

Applicable Law 

Your use of this Service under this Agreement is governed by the laws of the State of Illinois
